1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the website, services, tools, and content provided by Mama Knows Bets, LLC ("MKB," "we," "us," or "our"), including but not limited to our website at mama-knows-bets.com, data analytics tools (Value Finders, projections, models), Discord community, and any related services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

2. Entertainment & Informational Purposes Disclaimer

All content, data, projections, models, scores, picks, and analysis provided through MKB Services are for entertainment and informational purposes only.

MKB does not provide financial advice, investment advice, or gambling advice. Our Services provide sports analytics data and statistical models that users may use at their sole discretion. Nothing on this website or within our Services should be construed as a recommendation or endorsement to place any wager or bet.

We do not guarantee the accuracy, completeness, or reliability of any data, projections, models, or analysis provided. Sports outcomes are inherently uncertain, and past performance does not guarantee future results. You acknowledge that any decisions made using our data are made at your own risk.

3. Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is greater) to use our Services. By using our Services, you represent and warrant that you meet this age requirement.

You are responsible for ensuring that your use of our Services complies with all laws, rules, and regulations applicable to you in your jurisdiction.

4. Account Registration

To access premium features, you must create an account and subscribe to a paid plan. When creating an account, you agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain the security and confidentiality of your login credentials
  • Not share your account or credentials with any other person
  • Maintain only one account per person
  • Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate any account that we reasonably believe is being shared, used by multiple individuals, or used in violation of these Terms, without refund.

5. Subscription & Payment Terms

MKB offers subscription-based access to premium Services. Subscriptions automatically renew at the end of each billing period (weekly, monthly, or annually) unless canceled before the renewal date.

All payments are processed through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis for the applicable subscription fee.

Cancellation: You may cancel your subscription at any time through your account dashboard or the Stripe Customer Portal. Upon cancellation, you will retain access to premium Services until the end of your current billing period. No partial refunds are issued for unused portions of a billing period.

Price Changes: We reserve the right to change subscription pricing. Existing subscribers will be notified of any price changes in advance and will not be affected until their next renewal cycle unless they agree to the new pricing.

Failed Payments: If a payment fails, we will attempt to process the payment again. If payment cannot be collected after multiple attempts, your subscription may be canceled and access to premium Services revoked.

6. Intellectual Property

All content, data, tools, models, scores, projections, software, graphics, text, and other materials available through our Services are owned by or licensed to Mama Knows Bets, LLC and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use only. You may not:

  • Copy, reproduce, distribute, or publicly display any content from our Services
  • Resell, redistribute, or share subscription content with non-subscribers
  • Scrape, crawl, or use automated means to extract data from our Services
  • Use our data, tools, or content to create competing products or services
  • Screenshot, record, or redistribute premium content via social media or other channels

Violation of these intellectual property provisions may result in immediate account termination without refund.

7. Discord Community Guidelines

Access to our Discord server is provided as part of applicable subscription tiers. Your Discord access is linked to your subscription status and will be revoked if your subscription is canceled, expired, or terminated.

While participating in our Discord community, you agree to be respectful to other members, not engage in harassment, spam, or abusive behavior, and not share premium content with non-subscribers.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that (a) the Services will be uninterrupted, timely, secure, or error-free; (b) the data or content provided will be accurate, complete, or reliable; (c) any results obtained from use of the Services will be accurate or dependable; or (d) the quality of any data, tools, or content will meet your expectations.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MAMA KNOWS BETS, LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATED TO THE SERVICES EXCEED THE TOTAL AMOUNT PAID BY YOU TO MKB IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

You specifically acknowledge that MKB is not responsible for any financial losses, gambling losses, or other damages resulting from your use of our data, projections, models, or other content.

10. Indemnification

You agree to indemnify, defend, and hold harmless Mama Knows Bets, LLC, its owners, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any third-party rights.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Services after any changes constitutes your acceptance of the revised Terms.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the Services shall be resolved in the state or federal courts located in New Jersey.

TO THE EXTENT PERMITTED BY LAW, YOU AND MKB WAIVE ANY RIGHT TO A JURY TRIAL. ALL CLAIMS MUST BE BROUGHT IN THE PARTIES' INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE PROCEEDING.

13. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. Upon termination, your right to use the Services will immediately cease. Sections 2, 6, 8, 9, 10, and 12 shall survive any termination of these Terms.
